Terms and Conditions

This Short Term Rental Lease Agreement (this “Agreement”) is made by and between Zen Suites  (“Owner”) and the person making the reservation using VRBO/Homeaway/zensuitesnyc.com or their partner sites (“Guest”) as of the date guest make online reservation. Owner and Guest may be referred to individually as “Party” and collectively as “Parties.”  For good and valuable consideration, the sufficiency of which is acknowledged, the Parties agree as follows:

  SHORT TERM RENTAL LEASE AGREEMENT

1. Property.  The property is described as an apartment located in Jersey City, NJ (the “Property”).  The Property is fully furnished by Owner and equipped for light housekeeping.  The following amenities are included in the Property: 

  • Microwave
  • Dishwasher
  • Refrigerator
  • Electric stovetop
  • Coffee maker
  • Dinnerware
  • Cookware
  • Air conditioning
  • Heating
  • Washer
  • Dryer
  • Cable
  • Flat panel LED TV
  • DVD Player
  • Hi Speed Wi-fi
  • Outdoor swimming pool (open on seasonal basis)
  • Towels
  • Bed sheets

A starter supply of toiletries.  Guest is responsible for purchasing any additional supplies and all food and beverages. Guest acknowledges that there are certain risks associated with hot tubs. Use of the hot tub is at the user’s own risk, and Owner will not be responsible for any injuries.

Guest will have full access to building amenities subject to their availability. Guest must abide to Policies and procedures of the building while staying in the building. Guest must follow Policies and Procedures of the common area and amenities of the building.

2. Rental Party.  All persons in the rental party will be bound by the terms of this Agreement.  Maximum number of Persons allowed to stay is specified on the reservation details. Any guests above that must be approved by the owner. Guest agrees to provide name and age of all the occupants of the unit at least seven days before check-in.

3. Maximum Occupancy.  The maximum number of persons allowed to stay in the Property is limited to four unless the Owner gives its prior written consent.  A charge of $200 per person per night will be assessed for each person, who stays in the Property in addition to the Rental Party without prior approval.  Guest will be charged without notice for additional persons staying in the Property and not disclosed to Owner.

4. Visitors.  A visitor is an occupant of the Property who is not staying overnight.  The total number of persons permitted in the Property at any given time, including visitors, is six.  Any visitor staying overnight is subject to additional charges. No visitor will be allowed to use the common facilities, including any pools or tennis courts.

5. Rental Period & Check-In.  The term of this lease will be in accordance with dates listed on online reservation.If Guest or any member of the Rental Party remains on the Property beyond the Departure Date, Guest will be responsible to pay the rental rate prescribed in Section 8 below for the period of time between Departure Date and the actual date Guest and all members of the Rental Property vacate the Property.

  • Check-In time is 4 pm on Arrival Date. Guests can check-in any time after 4pm.
  • Check-out time is 11 am. Guests can vacate any time before 11 am.

Guests staying after 11am on Departure date, without prior permission from owner, will be assessed a charge of $100 per hour.

6. Keys & Access Codes.  Owner will provide Guest with two (2) electronic key(s), which will unlock the front door to the Property and all the common area.  Guest is not allowed to make duplicate keys.  A fee of $150.00 USD per key will be charged to Guest for failure to return a key.

7. Rental Rules & Restrictions.  Guest agrees to abide by the Rules and Regulations of Zen Suites, policies and procedures of the community and policies of using common areas and amenities of the building. and any other restrictions imposed by Owner (the “Rules”), attached to this Agreement as Exhibit B, at all times while on the Property and will cause all persons in the Rental Party and any visitors that Guest permits on the Property to abide by the Rules while on the Property. In addition, Guest agrees to abide by the following restrictions by Owner:

 (A)  Smoking is not permitted inside the Property 

 (B)  Pets are not permitted on the Property 

 (C)  Quiet hours are from 10:00 PM to 8:00AM 

 (D)  Garbage must be placed in the proper receptacles and must not be left in the Trash Room.

If any person in the Rental Party fails to follow any of the Rules, the Rental Party may be asked to vacate the Property and Guest will forfeit all rent paid. 

8. Reservation Deposit and Payment.  Guest agrees to pay the rent, taxes, fees and security deposit as described on VRBO/Homeaway/zensuitesnyc.com or their partner sites.

9. Security Deposit.  This deposit will be refunded after Guest’s departure and an inspection of the Property by Owner, less any deductions for damage to the Property or furnishings, excessive mess requiring additional cleaning or other costs incurred outside the normal course due to Guest’s stay. 

10. Cancellation. If Guest cancels the reservation less than one hundred eighty (180) days before the Arrival Date, the Daily Rent, Taxes and Fees will be forfeited. The strictest of cancellation policy listed on booking website or in this agreement will be enforced.

Guest will be eligible for full refund for :

  • Security Deposit
  • Housekeeping or Cleaning Fees and associated taxes

11. Payment.  Acceptable payment methods are: 

  • Credit card
  • Debit card
  • Paypal

12. Cleaning. A cleaning/housekeeping fee of $125.00 USD will be charged to the Guest. Daily housekeeping services are not included in the rental rate. Throughout the rental period, Guest will be responsible for keeping the Property clean and in good condition.  Any unsafe or dangerous condition must be reported to Owner immediately.  Guest acknowledges that on the Arrival Date, the Property is in good condition, except for any defect Guest may report to Owner by the end of the first day following the Arrival Date. The Property should be left in the same condition as it was found by Guest on the Arrival Date.  Guest promises to leave the Property in good repair.

13. Furnishings. The following furnishings will be provided with the Property:

  • Towels
  • BedSheets
  • Sleeping comforters
  • Beds
  • Mattress
  • Sofa bed/Couch
  • Dining Table/chair
  • Kitchen
  • TV
  • Internet

Furnishings are subject to change without notice.  Furniture, bedding, kitchen equipment, utensils, and any other personal property supplied with the Property must not be removed from the Property. Loss of any items within the Property or damage to the Property or furnishings in excess of normal wear and tear will be charged to Guest.  The Property will be inspected by Owner after Guest’s departure.  All contents of the Property are the property of Owner.  If an item should break, Guest must notify Owner immediately.  Guest is not permitted to alter the wiring of any television, computer, or gaming equipment. 

14. Parking.  Parking is offered by the owner at $30/day. If guest choose to use the parking facility, then parking must be purchased for entire duration of the stay @ $30/day. Guest will be provided the parking pass at time of check-in. Parking Pass must be returned at time of check-out and left in the apartment. Lost Parking pass will be charged @ $150/pass. If owner fails to provide parking then guest will be entitled to full refund of the parking fees.

15. Mechanical Failures.  Owner attempts to properly maintain the Property.  While all electrical and mechanical equipment within the Property are in good working order, Owner cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, air conditioning, audio visual equipment, internet access, cable service, or appliances.  Guest agrees to report any inoperative equipment or other maintenance problem to Owner immediately.  Owner will make every reasonable effort to have repairs done quickly and efficiently.  Guest will allow Owner or a person permitted by Owner access to the Property for purposes of repair and inspection.  Owner is not responsible for any inconvenience that may occur and no refunds or rent reductions will be made due to failure of such items. 

16. Amenities Availability. Common Area amenities are managed by building management. If any of the amenities are not available for part or the stay or entire stay then guest will not be entitled to any refund.

Guest must follow policies and procedures outlined in Exhibit B for using Commons Area and amenities.

16. Acts of God.  No refunds will be given if there is a storm or severe weather (i.e. hurricane, earthquake, forest fire) even if a mandatory evacuation order has been given. Owner will not be liable or deemed in default under this Agreement for any failure to perform or delay in performing any of its obligations due to or arising out of any act not within its control, including, without limitation, acts of God.

17. Limitation on Liability.  Owner is not responsible for any accidents, injuries or illness that occur to any member of the Rental Party or Guest’s visitors while in the Property or on the Property.  Owner is not responsible for loss of personal belongings or valuables belonging to any member of the Rental Party or any of Guest’s visitors.  Guest agrees to assume the risk of any harm arising from use of the Property.  UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL OWNER BE LIABLE TO GUEST OR ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE WHATSOEVER INCLUDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR GUEST’S RENTAL OF THE PROPERTY OR USE OF THE PROPERTY.  IN NO EVENT WILL OWNER BE LIABLE FOR ANY DAMAGES IN CONNECTION WITH THIS AGREEMENT, EVEN IF OWNER SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

18. Indemnification.  Guest acknowledges that the use of the Property by the Rental Party and Guest’s visitors is entirely at their own risk.  Guest will indemnify and hold harmless Owner from any and all expenses, costs, damages, suits, actions, or liabilities whatsoever arising from or related to any and all loss of or damage to personal property, injury or death resulting from the use or occupancy of the Property or the failure of any member of Rental Party or Guest’s visitors to observe the Rules and restrictions set forth in Paragraph 7. 

19. Violation of Agreement. If Guest or any member of the Rental Party violates any of the terms of this Agreement, including but not limited to maximum occupancy, visitors and rental rules and restrictions, Owner may evict Guest and the Rental Party from the Property and Guest will forfeit all rent and security deposit paid.

20. Governing Law.  This Agreement and all transactions contemplated by this Agreement will be governed by, and constructed and enforced in accordance with the laws of the State of New Jersey (not including its conflicts of laws provisions).  Any dispute arising from this Agreement shall be resolved through mediation. If the dispute cannot be resolved through mediation, then the dispute will be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association.

21. Amendments. This Agreement may be amended or modified only by a written agreement signed by both Owner and Guest.

22. No Waiver. Neither Owner nor Guest shall be deemed to have waived any provision of this Agreement or the exercise of any rights held under this Agreement unless such waiver is made expressly and in writing.

23. Severability. If any provision of this Agreement is held to be invalid or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid and enforceable as though the invalid or unenforceable parts had not been included in this Agreement.

24. Notices.  Any notice or communication under this Agreement must be in writing and sent via one of the following options:

 – personally delivered 

 – sent by overnight courier service 

 – certified or registered mail (postage prepaid, return receipt requested) 

 – electronic email transmission 

25. Successors and Assigns. This Agreement will inure to the benefit of and be binding upon Owner, its successors and assigns, and upon Guest and its permitted successors and assigns.

26. Entire Agreement.  This Agreement and Exhibit A represents the entire understanding and agreement between the Parties with respect to the subject matter of this Agreement and supersedes all other negotiations, understandings and representations (if any) made by and between the Parties.

  • FRONT DESK SERVICES ONLY TO INQURIES RELATED TO BUILDING. PLEASE CONTACT US FOR ANY OTHER QUESTIONS.
  • PLEASE DO NOT USE DISHWASHING LIQUID IN DISHWASHER.
  • PLEASE USE ONLY DISHWASHER DETERGENT IN DISHWASHER.
  • PLEASE DO NOT THROW FOOD IN SINK.
  • THROW FOOD IN GARBAGE ROOM ONLY.
  • TRASH ROOM IS RIGHT NEXT TO ELEVATORS.
  • PLEASE DO NOT WEAR SHOES ON CARPET.
  • RESPECT NEIGHBOURS. MOST OF THE PEOPLE IN BUILDING ARE RESIDENTS.
  • PLEASE DO NOT PLAY LOUD MUSIC OR TV.
  • PLEASE TURN OFF TV, A/Cs, HEATERS WHEN YOU ARE NOT IN THE APARTMENT.
  • FOOD DELIVERY: PLEASE PROVIDE UNIT # and Address.
  • NO PACKAGE DELIVERY.
  • AGAIN, NO SMOKING IN THE APARTMENT PLEASE.
  • PLEASE TURN-OFF THE STOVE AND LIGHTS BEFORE LEAVING APARTMENT.


USE OF COMMON AND AMENITY AREAS POLICIES:

Amenity areas including but not limited to Resident’s clubroom, fitness center, business center, etc. are to be utilized for their intended purposes only. Bicycles, skateboards, rollerblades, etc., may not be used in the parking lots or garages. Owner reserves the right to deny use of the amenities to any Resident found in violation of any of these policies. Proper-soled shoes must be worn to prevent damage to flooring. The Owner has designed the amenities for the Resident’s convenience.

a) Guest Policy: .

• No more than two (2) guest passes per apartment home will be issued on Holidays or Weekends.

• Guests must register during the week but are not limited with their number of guests, as long they don’t abuse the policy. Guests in excess of two (2) are allowed without a pass during the weekday but must have special advance permission from the Leasing Office.

• There will be no charge for children five (5) years of age and younger when accompanied by a Resident fourteen (14) years of age or older. All guests must be accompanied by a Resident of at least fourteen (14) years of age while using any of the amenities at the Community.

• No guest of the Resident may occupy the apartment for more than fourteen (14) days in a twelve (12) month period unless a residency application is filed with the Owner and accepted by the Owner. Occupancy by a guest beyond the above period shall constitute a breach of the Owner’s Policies and Procedures.

b) Swimming Pool:

• LIFEGUARD SUPERVISION: The Swimming Pool/Spa is SUPERVISED. The Pool should only be used when the Lifeguard is on duty. Instruction from the Lifeguard should be adhered to at all times.

• IDENTIFICATION OF RESIDENTS AND GUESTS: The Swimming Pool/Spa is available for use by Residents and their accompanying guests. Proper resident information is required and will be checked. There is a guest limit of two (2) guests per apartment. Guests agree to use the Swimming Pool/Spa at their own risk and will only be permitted when accompanied by the Resident.

• AGE REQUIREMENT: Persons under sixteen (16) must be accompanied by a parent or guardian.

• DIAPERS: Children in diapers are permitted in the Swimming Pool/Spa provided diapers are covered with rubber/plastic pants. Diapers may not be disposed of at the Swimming Pool/Spa site. They must be taken with the Resident when leaving the Swimming Pool/Spa.

• CONTAINERS: Please use only unbreakable containers in the Swimming Pool/Spa area.

• HEALTH DEPARTMENT REGULATIONS: As per health department regulations, the Swimming Pool/Spa is not to be used by anyone with an infectious disease; inflamed eyes; a cold; nasal or ear discharge; open sores; or bandages of any kind.

• TRASH: You must use the provided trash receptacles for cigarette butts, beverage containers and litter.

• BATHING SUITS: Regulation bathing suits must be worn in the pool and sauna area. No cut-offs or thongs are permitted.

• CONDUCT: You may not play with or misuse the ropes and life rings. You may not hang or sit on any ropes in pool. You may not wear hairpins or rollers or use excessive suntan oil in the pool. Profanity, horseplay, bicycle riding, skating, riding toys, scuffling, loud music or harassment of other swimmers will not be permitted. Owner and/or Owner’s agents may prohibit any activity at its sole discretion. Swimming devices (i.e. artificial flotation devices, floats, tubes, swimmies, etc.) will not be permitted in the pool.

• LIABILITY: Owner and/or Owner’s agents will not assume responsibility for any injury incurred in or around the Swimming Pool/Spa area.

• HOURS: Please refer to your move-in kit or to pool sign for pool hours. Pool is open from Memorial Day to Labor Day.

• OTHER POLICIES: You must follow other policies as posted in the pool and recreational facility area.

d) Billiards Room:

• Hours of Operation: 9 AM – 11 PM

• Billiards is to be played in a round-robin fashion. Residents should take turns playing and winner stays on the table.

• The Billiards Room is available for use by Residents and their accompanying guests. There is a limit of two (2) guests per apartment home. Guests agree to use the Billiards Room at their own risk.

• Please do not sit or walk on the billiard table.

• Food or drinks are not permitted on or near billiard table.

• Jump shots, masse shots, throwing balls, and hitting sticks are not allowed.

• Players are responsible for any and all equipment damaged.

• Please do not attempt to repair equipment at your own volition. Report any broken or damaged equipment to the Leasing Office.

• Management is not responsible for your lost or stolen items.

• Persons under the age of fourteen (14) are only permitted to use the table when accompanied by a parent or guardian.

e) Fitness Center:

• Hours of Operation: 5:00 AM – 12:00 AM

• The Fitness Center is not supervised. Please use at your own risk.

• The Fitness Center is available for use by Residents and their accompanying guests. There is a limit to two (2) guests per apartment home. Guests agree to use equipment at their own risk.

• Proper resident identification is required and will be checked.

• Be considerate! Unruly conduct or disrespect will not be tolerated. If someone is waiting to use a piece of cardio equipment, please limit your use to thirty (30) minutes.

• Please do not attempt to repair equipment on your own. Report any broken or damaged equipment to the Leasing Office.

• No food, drink or chewing gum is allowed in the Fitness Center. Only water bottles and sport drinks are allowed.

• Proper attire must be worn. Absolutely no sandals, boots or heels are permitted in the Fitness Center.

• Please wipe down equipment after each use.

• Owner and/or Owner’s agents are not responsible for any lost or stolen personal items.

• No children under the age of fourteen (14) are permitted in the Fitness Center.

• Children under the age of fourteen (14) are permitted in the Fitness Center only when accompanied and supervised by parent or guardian. Supervised means the parent or guardian responsible for the minor child must be able to see the child at all times and is actively watching the child to ensure the equipment is being used in the correct manner as it was designed.

• Parent or guardian is responsible for the safety and actions of the minor child while using the Fitness Center.

• No strollers, baby carriages, car seats or other child transportation devices are permitted in the Fitness Center.

f) Spa/Massage Room:

• Hours of Operations: 9 AM – 11 PM

g) Crayon Corner: Available only for Monaco Property.

• Hours of Operation: 9 AM – 8 PM

• The Crayon Corner is available for use by Residents and their accompanying guests. There is a limit to two (2) guests per apartment home. Guests agree to use the Crayon Corner at their own risk.

• Children must be accompanied by a parent or guardian who shall be responsible for the conduct and safety of their children.

• Do not remove toys from the room and return them to the location from which they were retrieved.

• It is the responsibility of the parents or guardian to ensure the playroom is left clean and tidy after each use.

• Please do not attempt to repair equipment on your own. Residents are responsible for any and all damage to the room and its contents.

• Owner/Owner’s agents are not responsible for any lost or stolen personal items.

• Diapers may not be disposed of Crayon Corner. They must be taken with the Resident when leaving the Crayon Corner.

• Please be courteous and share.

h) Theatre Room: Available only for Monaco Property.

• Hours of Operation: 9 AM – 11 PM

• The Theater Room is available for use by Residents and their accompanying guests. There is a limit to two (2) guests per apartment home.

Guests agree to use the Theater Room at their own risk.

• Parties are not permitted.

• Please do not attempt to repair equipment of your own volition. Please contact the Leasing Office.

• Food or drinks are not permitted on or near the equipment.

• Inappropriate viewing material or behavior will not be tolerated.

• Residents are responsible for any and all equipment damage.

• Owner/Owner’s agent is not responsible for any lost or stolen personal items.

• Persons under the age of fourteen (14) are only permitted when accompanied by a parent or guardian.

i) Conference Room: Available only for Monaco Property.

• Hours of Operation: 9 AM – 11 PM

• If you would like to reserve the Conference Room, please see our Leasing Office for details.

• Food or drinks are not permitted on our near the equipment.

• Please do not attempt to repair damage on your own. Residents are responsible for any and all damage to the room and its contents.

• Owner/Owner’s agent is not responsible for any lost or stolen personal items.

• Persons under the age of fourteen (14) are only permitted when accompanied by a parent or guardian.

j) Clubroom/Clubhouse:

• Hours of Operations: 9 AM – 11 PM

• Private parties are not permitted.

• Please do not attempt to repair items in the room on your own. Residents are responsible for any and all damage to the room and its contents.

• Owner and/or Owner’s agent are not responsible for any lost or stolen personal items.

• Persons under the age of fourteen (14) are only permitted when accompanied by a parent or guardian.

k) Playground: Available only for Monaco Property.

• Hours of Operation: 9 AM – 11 PM

• The Playground is not supervised. Please use at your own risk.

• To avoid burns, parents and guardians should check for hot playground surfaces before allowing children to play.

• To avoid strangulation, do not wear helmets, necklaces or closing with hoods, cords or drawstrings while using playground equipment.

• Do not play on broken or damaged playground equipment. Report broken or damaged equipment to the Leasing Office immediately.

• Please do not attempt to repair equipment on your own. Residents are responsible for any and all damage to the area.

• Owner and/or Owner’s agent are not responsible for any lost or stolen personal items.

• Do not walk up or climb slides. Slide feet first, face forward in a seated position, one person at a time.

• Do not climb on or over safety rails, walls, barriers, roofs and swing frames.

• Do not run on, jump off or dive off playground equipment.

• Do not walk or climb on top of overhead ladders (monkey bars). Use overhead ladders one rung at a time.

• Swing in a seated position and do not twist chains or jump out of swings.

• Take turns on all playground equipment

• No pushing, shoving or rough stuff.

• Be careful when the equipment is wet.

• Use the equipment correctly.

• And above all, have fun and play safely!

l) Trash/Rubbish Room:

• Please place recyclables in the appropriate receptacles.

• Make sure only trash is placed in the trash chute and trash bags are firmly tied.

• Do not shove or force the trash bag down the chute. If the trash bag is too large for the trash chute, please dispose of in the bulk trash area.

• Do not leave trash or recyclables on the floor.

• Do not leave cardboard boxes in the trash room. Please break them down and dispose of in the proper bulk trash area.

• Please place recyclables in the appropriate receptacles.

• Make sure only trash is placed in the trash chute and trash bags are firmly tied.

• Do not shove or force the trash bag down the chute. If the trash bag is too large for the trash chute, please dispose of in the bulk trash area.

• Do not leave trash or recyclables on the floor.

• Do not leave cardboard boxes in the trash room. Please break them down and dispose of in the proper bulk trash area.

• The use of the fire pit area is at your own risk.

n) BBQ Grills/Area:

• Hours of Operation: 9 AM to 11 PM

• This amenity area is for the use and enjoyment of our residents and their guests.

• Please keep in mind the following:

• The BBQ Grills and Area ARE NOT SUPERVISED. PLEASE USE AT YOUR OWN RISK.

• The BBQ Grills and Area is available for use by Residents and their accompanying guests. There is a limit of two (2) guests per apartment home. Guests agree to use the BBQ Grills at their own risk.

• Private parties are not permitted.

• Glass containers are not permitted in the BBQ Grill Area.

• Please do not attempt to repair the grills on your own and report any damage to the leasing office.

• Management Company is not responsible for any lost or stolen personal items.

• No one under eighteen (18) years of age is permitted to use the BBQ grills without adult supervision.

• Do not attempt to use charcoal or lighter fluid with the gas grills.

• Please turn off the grills after each use.

• Please clean the grills after each use with the brushes provided.

                                    COMMUNITY POLICIES AND PROCEDURES:

The apartment and the Community, including all buildings, common grounds, amenity and parking areas, are collectively called “the Premises.” The Resident acknowledges receipt of these Policies and Procedures prior to moving in and agrees to comply with them. Failure to comply with the Policies and Procedures is a breach of this Lease. Resident, Resident’s family, their employees, agents, visitors, licensees and invitees shall comply with the Policies and Procedures. The Owner reserves the right to cancel or modify any of the Policies and Procedures and to make other changes and regulations from time to time as may be deemed necessary. Resident will be required to comply with any such amendments or supplements to the rules and regulations, after due notice of same.

a) Speed Limit: Resident shall limit speed within the Premises to 10 MPH. Recreational vehicles are not permitted; in designated areas only. Resident must obey all signs and traffic control devices within the garage, such as stop signs, fire lanes, etc.

b) Vehicles: Unsightly cars (such as cars with flats, broken windows, etc.) and vehicles with expired tags will not be permitted to remain on the Premises. Vehicles are not to be repaired or serviced on the Premises. A repair is anything that requires the vehicle to have the hood open or to be up on a jack. Vehicles may: () not be washed on the Premises. Do not empty car ashtrays onto the parking lots. Vehicles will be towed at Owner’s expense, and without notice, that are (a) not properly registered with the city and state and with the Management, (b) parked in a fire lane or in a designated “NO PARKING” area, (c) that are owned or used by Residents and are parked in Leasing Office and Visitor parking spaces, and/or (d) parked in a space other than the assigned space for that vehicle. Resident must register all vehicles with the Management.

c) Garages/Parking: If the Resident elects to park on the Premises, Resident agrees to use the provided garage, assigned as part of the premises under the Lease, for the parking of motor vehicles, which does not preclude the parking of motor vehicles. Under no circumstances is Resident to use the assigned garage for storage of any objects, possessions or belongings, other than for a motor vehicle, which impairs or precludes the parking of motor vehicles. The use of the garage for commercial or repair purposes is strictly prohibited. Owner reserves the right to demand the removal or clearing of any objects, possessions or belongings, which impairs the use of the garage for parking of motor vehicles. The Resident is to park motor vehicles in the garage and in assigned spaces. Parking in the access ways of the community is strictly prohibited. Vehicles that are parked on access ways will be towed.

d) Draperies: Draperies, curtains or blinds must be placed at all windows within two weeks of moving into the apartment, if applicable. The window coverings visible from the exterior must be lined with a neutral-colored material. Neutral colors are defined as white, off-white, beige and light gray. If the primary draperies or curtains are not of these neutral colors, then they must be lined with neutral colors on the outside. There may be no tin foil, sheets, blankets, or any type of coverings other than draperies, curtains or blinds over the windows to darken rooms.

e) Balconies/Patios/Decks: Resident may not hang bathing suits or store brooms, mops, rugs, etc. on the balcony or in front of the apartment. Mops, clothes, rugs, etc. may not be shaken from balconies/patios/decks or windows. Dirt, debris and/or water may not be swept over the edge of any balcony. Cigars, cigarettes, and any other objects shall not be thrown from any window or balcony/patio/deck. No household appliances, mechanical equipment, barbecues, bicycles, or trash are to be kept on balconies/patios/decks. No radio aerials are permitted. Absolutely no grilling on balconies/patios/decks is permitted.

f) Equipment: The equipment in the bathrooms and kitchens is not to be used for any purposes other than that for which it was constructed. No sweepings, rubbish, rags, disposable diapers, sanitary napkins, tampons, ashes or other obstructive substances may be thrown therein. Resident may not place metal, string, dental floss, grease, coffee grounds, nut shells, glass, olive or fruit pits, corn cobs, paper, wire, bones or non-food in disposal or sinks. If you cannot eat it, your disposal cannot eat it! Resident shall be responsible for all damages resulting from the misuse of such equipment and Resident agrees to reimburse us for the costs incurred to repair such equipment and related damages. Portable washers or dryers not approved in writing by Owner are prohibited.

g) Shower Curtains: All Residents will be responsible for purchasing a shower curtain and liner at least 82 inches or 6’10” in height to be used in any and all bathrooms within the apartment home. All liners need to be at a minimum length to cover the distance from the shower rod to the inside of the tub to ensure water will not leak from sides of tub. If a Resident does not provide the proper curtain and liner they may be held responsible for any damages due as a direct result of a short shower curtain or liner.

h) Noise: All residents must be considerate of their neighbors. Residents must control the volume of radios, stereos, TV’s, computers, musical instruments and other amplified devices so that they do not disturb Residents of other apartments. Owner requires that stereo speakers not be placed directly on the floor. Noisy or disorderly conduct that annoys or disturbs Residents will not be permitted that is not in accordance with the City, County, or State ordinance. A single violation of this covenant shall be deemed a breach thereof.

i) Laundry Facilities: Please report to the Owner machines that are not operating properly. When using laundry machines, please do not wash or dry shoes in the machines. Shoe may bump up against and damage the machines. Resident agrees to be responsible for damage(s) resulting from the misuse of the laundry equipment and to reimburse Owner for the costs incurred to repair the laundry equipment; such costs shall be considered additional rent.

j) Storage Facilities: Storage facilities are available with some apartment styles. Do not store flammable or hazardous chemicals.

k) Wall Hangings: Resident may use nails and regular hangers when hanging pictures, mirrors, etc. Resident may not use adhesive hangers, since they damage the wallboard. No holes shall be driven into the cabinets, woodwork, ceiling or floors. Please do not use a nail or any other hanger on wallpaper.

l) Trash: Trash is not to be left outside the apartment or on the balcony, and is not to accumulate within the apartment. There is a trash chute or trash dumpster enclosure located on each floor in a specified location on the property. Please throw all trash into the trash chute. Do not leave debris on the floor. Throw newspapers into the recycling bin, labeled for paper that is located in each trash room. Check to be sure all ashes and cigarette butts are completely out before putting trash in the compactors. Furniture items such as desks, chairs, beds, mattresses, sofas, etc. are not to be left on the Premises for disposal. Resident is responsible for the removal of these items and all costs associated therewith. Residents not complying with these policies regarding trash are subject to a fine in the amount of $50.00 per bag or large item of trash that we remove, at the discretion of the Director of Operations.

m) Clutter: Common areas must be kept clear at all times. No items are permitted in the parking areas, courtyards, sidewalks, lawns or other common areas of the building. All articles will be immediately impounded, and a charge may be made for their return.

n) Smoking: Smoking is not permitted in the hallways and lobby area. Smoking is likewise prohibited in the health and recreational facilities. Cigarette butts are not to be discarded on the Community grounds. RESIDENT MAY NOT THROW CIGARETTE BUTTS IN THE MULCH OR IN PROXIMITY TO THE BUILDING. DOING SO IS A SEVERE FIRE HAZARD.

o) Dry Cleaning: If this drop-off/pickup service is provided, it is done so as a convenience and Resident agrees not to hold Owner or its agents responsible in the event of loss or damage of any or all dry cleaning. Resident agrees to pick up dry cleaning within forty-eight (48) hours’ notice.

p) Packages: Resident authorizes Owner to accept US Mail, UPS, DHL, Fed Ex, etc. packages on behalf of the Resident. This service is provided as a convenience and Resident agrees not to hold the Owner or its agents responsible for accepting the package in the event that is lost or damaged. Resident agrees to pick up the package(s) with twenty-four (24) hours’ notice to avoid return unless Resident makes other arrangements. The concierge will only accept packages that are completely and accurately addressed to the recipient and which are non-perishable. The concierge will not accept packages over fifty (50) lbs. The concierge will not accept furniture such as sofas, tables, beds, mattresses, bedroom sets, tires, and other similar items. Packages must be no larger than a twenty-four (24) x forty-eight (48) inch box.

q) Waterbeds: Waterbeds are not permitted.

r) Heaters: Kerosene heaters or other heaters using combustible materials or fluids are not permitted on the Premises.

s) Cooking: Please cook in a manner that will not offend or annoy other Residents and use the oven fans during cooking.

t) Doors: Resident must shut all doors leading from and into the Premises at all times.

u) Moving Furniture: Moving of furniture is permitted to and from the apartments only between office hours. Resident must remove any packing cases, barrels or boxes, which are used in moving. If packing cases, barrels, boxes or other containers are removed by the Owner, Resident will be billed for the cost of such a removal as additional rent.

v) Safekeeping of Articles: Owner’s employees, other than front desk attendants, will not accept keys or articles of any description from or for the benefit of the Resident. If packages, keys or other articles are left with the employees of this building, the sole risk of loss or damage is upon the Resident.

w) Bicycles: If provided, bicycles are to be stored in the garage in the bicycle storage room at Resident’s own risk. Bicycles are not to be moved through any lobby or left on balconies/patios/decks.

x) Prohibited Devices: Drones, Hoverboards, self-balancing scooters, hands-free Segways, electric-powered skateboards and similar devices are prohibited. There have been reports of “hoverboards,” otherwise known as “balancing scooters,” spontaneously bursting into flames, causing fires and explosions, in homes and elsewhere. The U.S. Consumer Product Safety Commission has cited 12 such incidents in the United States, and other countries have reported similar problems. The Owner deems it to be in the best interest of the community to prohibit the possession and use of these devices inside apartments and in common areas within the community. Breach of this provision shall constitute a default under this Lease, and Owner may exercise the rights and remedies available to the Owner including the right to terminate this Lease.

y) J-Box/Wiring: Owner has installed J-Boxes, in all dining rooms for the Resident’s convenience. Such J-Box shall permit the Resident to install a light fixture of their own choice, at their own expense. Light fixture must weigh no more than 25 pounds. Resident shall use all reasonable care when installing the light fixture and any damages caused to the J-Box shall be at the Resident’s expense, to be charged as Additional Rent. Resident may not install or tamper with any wiring in or outside of the Premises or install any aerial for television or radio on roof, balcony or exterior of building.
